The change is decided at the Owners’ Meeting, with the item expressly included on the agenda. Andorra’s Llei 12/2004 on horizontal property sets a four-year term for the governing bodies, unless the statutes provide otherwise, and allows their removal by resolution of the Meeting held in extraordinary session. The incoming property manager must be registered with the Col·legi d’Agents i Gestors Immobiliaris d’Andorra, and the outgoing one must hand over accounts, contracts and community records.
An owner who is not up to date with all debts due to the community when the Meeting opens may take part in the discussion but loses the right to vote. The debt is not merely personal either: the property itself answers for the outstanding amounts, which also affects any buyer. The community may claim the unpaid sums through the courts. Resolutions and notifications should be properly documented before starting any claim.
Yes. The law does not make voting rights conditional on residence, but on being an owner and up to date with payments. Anyone unable to attend in person may appoint a representative: a written document signed by the owner is enough, and each attendee may hold a maximum of six proxies. Every owner must, however, provide the community with an address in the Principality for summonses and notifications.
The chairperson is necessarily appointed from among the owners and represents the community, both in court and outside it, in all matters affecting it. This power may be delegated in writing to the secretary-manager. The role is one of representation and oversight: the chairperson ensures that the Meeting’s resolutions are carried out, while day-to-day and accounting management falls to the property manager. To define responsibilities in a specific case, let us review your community’s statutes together.
Leave the problems to us. We handle the transition from your
current manager at no extra cost and with a full entry audit.
